Terms and Conditions – Zeeuws Meisje

(trading under Zeus Art Projects B.V.)

1. Identity of the entrepreneur

Zeeuws Meisje is a trade name of Zeus Art Projects B.V., located at Van Hattumstraat 14, 4437 AG Ellewoutsdijk, Netherlands, registered with the Chamber of Commerce under number 93462891.

Zeeuws Meisje specializes in designing and selling (custom-made) artworks and photographic reproductions, including those on dibond and plexiglass, via an online Shopify webshop.

2. Definitions

In these general terms and conditions, the following terms are understood to mean:

  • Zeeuws Meisje: the company that offers products remotely and is the user of these general terms and conditions.

  • Consumer: the natural person who is not acting in the exercise of a profession or business.

  • Business buyer (B2B): the natural person or legal entity acting in the exercise of a profession or business.

  • Distance contract: an agreement concluded via the Zeeuws Meisje webshop.

  • Custom product: a product manufactured specifically according to the specifications provided by the consumer or buyer, including but not limited to size, material, finish, color scheme, or image cropping.

  • Non-custom products: card sets and books. These products are explicitly not considered custom-made.

  • In writing: communication by email or post.

3. Applicability

  1. These general terms and conditions apply to every offer, every agreement, and every delivery of products by Zeeuws Meisje.

  2. General terms and conditions of the consumer or buyer are explicitly rejected, unless otherwise agreed in writing.

  3. Zeeuws Meisje reserves the right to amend these terms and conditions. The current version is always the version in force at the time the agreement was concluded.

  4. If one or more provisions are null and void or are annulled, the remaining provisions shall remain in full force and effect.

4. The Offer

  1. All offers in the webshop are non-binding and subject to availability.

  2. Prices include VAT, unless expressly stated otherwise.

  3. Zeeuws Meisje is not bound by obvious mistakes or errors in the offer, including printing, typing, or programming errors.

5. Formation of the agreement

  1. The agreement is concluded at the moment the consumer or buyer:

    • accepts the offer via the webshop; and

    • completes the order in full.

  2. After completion, the consumer or buyer will receive an electronic order confirmation.

  3. Zeeuws Meisje reserves the right to refuse an order or impose additional conditions.

6. Right of withdrawal (consumers)

  1. The consumer has the right to dissolve an agreement for a non-customized product within fourteen (14) days of receipt without giving reasons.

  2. During the reflection period, the consumer must handle the product and its packaging with care.

  3. Returns must be made within fourteen (14) days after notification of withdrawal. The costs of return shipment are for the consumer.

Exclusion of right of withdrawal

  1. The right of withdrawal is explicitly excluded for:

    • customized products manufactured according to the specifications of the consumer or buyer.

  2. Card sets and books are not considered custom-made and therefore have the regular right of withdrawal.

This exclusion is based on Article 6:230p sub f of the Dutch Civil Code.

7. Business customers (B2B)

  1. There is no right of withdrawal for business buyers, unless otherwise agreed in writing.

  2. All deliveries to business buyers are made excluding any statutory consumer protection.

8. Delivery and shipping

  1. Zeeuws Meisje will execute orders within thirty (30) days at the latest, unless otherwise agreed.

  2. Delivery takes place via an external carrier.

  3. The risk of damage or loss passes at the moment of delivery to the consumer or buyer.

  4. Shipping costs are included in the price, unless otherwise stated.

9. Prices and payment

  1. Payment must be made using the payment methods offered in the webshop.

  2. Invoices must be paid within seven (7) days of the invoice date at the latest, unless otherwise agreed.

  3. Zeeuws Meisje remains the owner of the delivered products until full payment has been made.

10. Discounts

  1. Discount codes are personal and non-transferable.

  2. Discount codes are not valid in combination with other promotions, for previous purchases, or for international shipping (with the exception of Belgium).

  3. Discounts cannot be exchanged for cash.

11. Warranty and liability

  1. Zeeuws Meisje offers the statutory warranty according to Dutch law.

  2. Warranty expires if:

    • the product has been used incorrectly;

    • the product has been modified or repaired by the consumer or third parties.

  3. The liability of Zeeuws Meisje is limited to the invoice amount of the product concerned, unless there is intent or gross negligence.

12. Complaints

  1. Complaints must be reported in writing as soon as possible, but no later than fourteen (14) days after discovery.

  2. Zeeuws Meisje will respond within seven (7) days of receiving the complaint.

  3. Disputes can also be submitted via the European ODR platform or an accredited dispute resolution body.

13. Applicable law and disputes

  1. All agreements are exclusively governed by Dutch law.

  2. Disputes will be submitted to the competent court in the district of Zeeland-West-Brabant, unless mandatory law dictates otherwise.

  3. Parties will endeavor to resolve a dispute through mutual consultation first.
